INSTRUCTIONS FOR OBTAINING A SIX-MONTH EXTENSION OF THE DEADLINE TO FILE A TAX RETURN

What Forms Do I Need?

Form 4868 is for obtaining an extension for filing your Federal income tax forms. Form IT-370 is for obtaining an extension for filing your New York State income tax forms. Both forms are available in the Office of International Student and Scholar Services (ISSS) or may be downloaded from:

Both forms include instructions.

Who Should Use These Forms?

If you will not be able to file your tax returns by the April 17, 2012 deadline (either because you weren't able to complete all the paperwork OR because you are lacking important required forms, such as form W-2 or 1042-S) then you must file form 4868, and, if necessary, IT-370 on or before April 17.

Forms 4868 and IT-370 provide an automatic six month extension. However, form 4868 and IT-370 do not allow for an extension of taxes owed. If you owe tax to the U.S. government or the State of New York, you must enclose payment (or an estimated payment) with the appropriate form.

Filing Instructions:

For Form 4868, Complete all items in Part I. In Part II, line 4, enter the amount from form 1040NR EZ line 17 or form 1040NR line 59. In Part II, line 5, enter the amount from form 1040NR EZ line 21 or form 1040NR line 68 (excluding line 63). In Part II, line 6, subtract line 5 from line 4. If line 5 is more than line 4, enter "0". Line 7 should indicate the amount of tax payment you are enclosing with this form (if any).

For Form IT-370, complete all of the information requested in the box at the bottom of the form. Before completing items 1 and 2 of the form, use the worksheet on Page 2. On line 1 of the worksheet, enter the amount from IT-203 line 66. On line 2 of the worksheet, if you had an amount on IT-203 line 52a, enter it here. Otherwise leave line 2 blank. On line 3 of the worksheet, if you had an amount on IT-203 lines 53 and 54, enter it here. Otherwise, leave it blank. On line 4 of the worksheet, enter the amount from IT-203 line 56. Also enter this amount on line 1 of the front of this form. If you had an amount on form IT-203 line 70, enter that amount on line 2. You will then need to enclose payment for that amount.

Make a copy of each form BEFORE you mail it in, and send form 4868 to: 
Internal Revenue Service Center P.O. Box 660575 Dallas, TX 75266-0575 if you are enclosing a payment for taxes due OR to Internal Revenue Service Center, Austin, TX 73301-0215 if you are not enclosing a payment.

Do not attempt to file the 4868 or IT 370 electronically... file it as a paper form.
